These Terms of Service (“Terms”) govern your access to and use of the Loser Labs website at loserlabs.io and any applications, products, or services offered by Loser Labs that link to these Terms (collectively, the “Services”). By accessing or using the Services you agree to be bound by these Terms.
You must be at least 13 years old to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Loser Labs publishes editorial content, design work, and software, and may also offer email subscriptions, downloadable apps, and other products. We may add, change, or discontinue features at any time. We do not guarantee the Services will be uninterrupted or error-free.
Some features may require you to provide an email address or other information. You agree to provide accurate information and to keep it current. You are responsible for activity that occurs under any account you create. You will not use the Services to send unsolicited bulk communications, transmit malicious code, or interfere with anyone else's use of the Services.
The Services, including text, graphics, logos, software, and other content provided by Loser Labs, are owned by Loser Labs or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You will not copy, modify, distribute, reverse engineer, or create derivative works from the Services except as permitted by these Terms or applicable law.
If you submit content to us (for example, feedback, ideas, or messages), you grant Loser Labs a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content for the purpose of operating and improving the Services. You represent that you have the rights necessary to grant this license.
The Services may link to or rely on third-party websites, apps, or services. We are not responsible for those third parties, and your use of them is subject to their own terms and policies.
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Loser Labs disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by law, Loser Labs and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed one hundred U.S. dollars (US$100).
You agree to indemnify and hold Loser Labs harmless from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.
We may suspend or terminate your access to the Services at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Services at any time.
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. The exclusive venue for any disputes will be the state or federal courts located in Delaware.
We may update these Terms from time to time. When we make material changes we will update the “Effective” date above and, where appropriate, provide additional notice. Continued use of the Services after changes take effect means you accept the revised Terms.
